Subscriber Agreement, Liability Release, and Marketing Release (“Terms of Service”)
This document serves as the Subscriber Agreement, Liability Release, and Marketing Release ("Agreement") between the Subscriber ("Subscriber" or "you") and Sure Solutions, LLC, doing business as Doorstep Music Lessons ("Doorstep Music Lessons," "we," "us," or "our"). By utilizing our services, beginning from the date of your first purchase with Doorstep Music Lessons, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this Agreement. Please read this Agreement carefully.
1. Subscriber Agreement
1.1 Subscription Services
1.1.1 Subscription Service: Doorstep Music Lessons offers a subscription service for music lessons ("Subscription Service"). By subscribing, you will receive scheduled music lessons delivered to your designated location as specified during your subscription process.
1.1.2 Payment: You agree to provide your credit card, debit card, or bank ACH details to us. You authorize Doorstep Music Lessons to automatically charge your credit card, debit card, or bank account on the same date each month, which corresponds with your subscription start date. Your card information will be securely stored on file. Payment amounts will be based on your chosen subscription package.
1.2 Subscription Terms
1.2.1 Subscription Period: Your subscription will be billed on a monthly basis. The subscription period ("Subscription Period") will begin on the date you subscribe and continue until you cancel in accordance with Section 3 of this Agreement.
1.2.2 Price Changes: Doorstep Music Lessons reserves the right to change subscription prices at any time, with notice. You will be provided with notice of any price changes at least 21 days before they take effect.
1.2.3 Automatic Renewal: Your subscription will automatically renew for successive monthly Subscription Periods. You must cancel your subscription in accordance with Section 1.3 to avoid automatic renewal charges.
1.3 Cancellation
1.3.1 Cancellation by Subscriber: You may cancel your subscription by requesting a Subscription Cancellation Request Form from Doorstep Music Lessons and submitting the signed form to Doorstep Music Lessons. The Subscription Cancellation Request Form must be received at least seven (7) calendar days before your next scheduled billing date to guarantee that you will not be charged for the renewal. Your Subscription Cancellation Request Form must be signed by the billing contact on your account. If your Subscription Cancellation Request Forms is received less than seven (7) calendar days before your next scheduled billing date, you may still be charged for the renewal.
1.3.2 Effect of Cancellation: If you cancel your subscription within the cancellation notice period, your subscription will terminate at the end of the current Subscription Period. No further charges will be incurred. Doorstep Music Lessons will not provide refunds or credits for partial Subscription Periods.
1.3.3 Cancellation by Doorstep Music Lessons: Doorstep Music Lessons reserves the right to cancel your subscription at any time, with or without cause. In the event of such cancellation, you will receive a prorated refund for any untaught regularly scheduled lessons in your subscription period and for any outstanding make-up credits on the account. Make-up credits can only be earned via teacher cancellations in accordance with the teacher cancellation policy. Lessons that are cancelled by you are considered family cancellations under the family cancellation policy and are not eligible for refunds, even if your teacher has agreed to provided a make up lesson for the family cancellation.
1.4 Registration Fee
1.4.1 One-time Fee: There is a one-time registration fee of $30 per family. The registration fee is non-refundable. The registration fee does not need to be paid again if you add more students, more time or additional lessons to your subscription.
1.4.2 Re-enrollment Fee: If you cancel lessons and wish to re-enroll at a future time, a re-enrollment fee of $30 will be due.
1.5 Refund Policy
1.5.1 Tuition Refund: Tuition is refundable until 24 hours prior to the scheduled date and time of your first lesson. After this time, tuition is non-refundable except as described in section 1.3.
1.6 Modifying Subscription
1.6.1 Modifying Subscription: You may modify your subscription to change the number of lessons, increase or decrease the duration of lessons, add additional students, or add additional instruments by contacting Doorstep Music Lessons. Any modifications may be subject to additional fees and must comply with the existing subscription terms.
2. Liability Release
By utilizing our services, you acknowledge and agree to the following liability release terms:
2.1 Assumption of Risk: You understand and acknowledge that participation in music lessons, events, or any activities organized by Doorstep Music Lessons carries inherent risks. You voluntarily assume all risks associated with such participation, including but not limited to physical injury, property damage, or any other loss that may arise during or as a result of the lessons or related activities.
2.2 Release of Claims: You hereby release and discharge Doorstep Music Lessons, its affiliates, owners, employees, representatives, and agents from any and all claims, liabilities, demands, actions, or causes of action, whether arising out of negligence or otherwise, related to any injury, loss, or damage incurred during or as a result of participating in the music lessons or any associated activities.
2.3 Presence of Responsible Adult: You understand and agree that a responsible adult must be present in the home for the entire duration of the lesson for any student under 18 years old. Doorstep Music Lessons shall not be held liable for any incidents or accidents that may occur due to the absence of a responsible adult during the lesson.
2.4 Teacher Conduct: You acknowledge that Doorstep Music Lessons takes measures to screen teachers for their musical ability and runs criminal background checks on all teachers. If any misconduct is reported, Doorstep Music Lessons will investigate and take appropriate action to protect all teachers, families, and students.
2.5 Binding Agreement: You affirm that you have carefully read this liability release, fully understand its contents, and voluntarily agree to its terms without coercion or undue influence. You further acknowledge that this release shall be binding upon you, your heirs, executors, administrators, and assigns.
2.6 Representations and Warranties: By agreeing to this Agreement, you represent and warrant that you have the authority to sign on behalf of any students who will be taking lessons if you are not the person taking lessons. If you are agreeing as the parent/legal guardian of a student under 18 years old, you further confirm that you have the legal authority to enter into this Agreement on behalf of the minor student.
2.7 Indemnification: You agree to indemnify and hold harmless Doorstep Music Lessons, its affiliates, owners, employees, representatives, and agents from and against any loss, claims, or damages for any injuries arising from music lessons to any student, person in the household, or any other person present at the lesson location, whether such injuries arise during or as a result of the lessons or related activities.
3. Marketing Release
By utilizing our services, you acknowledge and agree to the following marketing release terms:
3.1 Media Use Consent: You hereby grant Doorstep Music Lessons, its affiliates, agents, and representatives, the unrestricted, worldwide, perpetual right and permission to use photographs, likeness, audio recordings, video recordings, and any other media content depicting you (or your child if under 18 years old) in promotional and advertising materials, including but not limited to social media, websites, and other marketing platforms. We require our contractors to remove the metadata related to location information before delivery of media to us, but we make no guarantees that it will be removed.
3.2 No Compensation: You understand and agree that the use of such media content is without compensation, and you release Doorstep Music Lessons from any and all claims, demands, actions, or causes of action related to the use of said media content.
4. Representations and Warranties
4.1 Representations and Warranties: By using our services or requesting information from us, you represent and warrant that you are not now, nor have you been in the last two years, a client, family, student, or employee of or a contractor with Lessons In Your Home or its subsidiaries.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, Harris County.
6. Arbitration Clause
Any dispute, controversy, or claim arising out of or relating to this Agreement, including the breach, termination, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of arbitration shall be Houston, Texas. The language of the arbitration shall be English.
7. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable in any jurisdiction, the validity, legality, or enforceability of the remaining provisions shall not be affected or impaired, and such provision shall be ineffective only to the extent of such invalidity, illegality, or unenforceability without affecting the remaining provisions of this Agreement.
8. Changes to Terms
Changes to Terms: Doorstep Music Lessons reserves the right to modify these terms and conditions at any time. Any changes will be effective upon posting of the updated Agreement on our website. We will notify you of any significant changes to the terms and conditions via email or through your account. Your continued use of our services after such changes will constitute your acceptance of the new terms and conditions.
9. Entire Agreement
This Agreement constitutes the entire agreement between you and Doorstep Music Lessons with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to such subject matter.
